Mediation is an affordable alternative for dispute resolutions. Mediators assist with difficult conversations to find mutual agreements between parties. Mediators are neutral parties that aim to help parties identify their needs and interests. All mediations are confidential and private. The process is informal and flexible and results in a win/win situation.
The Mediation Process
Introduction
A brief explanation of goals, rules and information regarding the process.
Opening Statements
Both parties has an opportunity to describe their views on the disputes and the results of the dispute on each party.
Joint Discussion
Here the disputes are discussed in more detail and suggestions to conflict resolutions are addressed.
Private Conferences
Each party has an option for private meetings to discuss specific issues that is not leading to a resolution during the joint discussions.
Joint Negotiations
Agreements are discussed and noted in a written memorandum of understanding. Parties may choose to move forward with litigation if they feel no agreement has been reached.
Closure
Once an agreement has been reached, parties sign a legally binding contract of agreement.
